The platform is intended as a planning aid and community resource, not as a substitute for professional canyoning training or on-site assessments. You are solely responsible for your own safety and for evaluating the risk of any route or location.

3. Disclaimers and Safety Notice
We do not guarantee the accuracy, completeness, or safety of any canyon data, tracks, or route descriptions provided by us or by other users.Canyoning involves significant risks, including physical injury and death. You are responsible for ensuring your personal skills, safety equipment, group composition, weather conditions, and route assessment.Under no circumstances shall we be liable for any damage or injury resulting from the use of our platform.

4. Intellectual Property
All rights, including intellectual property rights, to the platform and its contents (excluding user-generated content) are owned by us. You may not copy, modify, or distribute our content without prior written consent.

5. User-Generated Content & Licensing
When you upload, submit or otherwise make available any data (including but not limited to: GPX files, trail descriptions, photos, comments, ratings, or metadata), you grant us an exclusive, worldwide, transferable, sublicensable, royalty-free, and irrevocable license to use, copy, distribute, modify, translate, publicly display, commercially exploit, and incorporate your content into other works or products, in any format and for any purpose. You agree that we may publish and commercially use your content without compensation to you. You warrant that:
- You are the sole owner of the uploaded content or otherwise have the full legal right to grant the above license.
- Your content does not infringe any third-party rights.
We reserve the right to remove or modify any content at our sole discretion.

6. Privacy
Please refer to our separate Privacy Policy for details on how we collect and process personal data.

7. Account and Termination
We reserve the right to suspend or terminate your access if you violate these terms or abuse the platform.

8. Generated Content
8.1 Ownership of Generated Content
All images, graphics, maps, or other content generated through our Topo Generator (collectively, "Generated Content") are and remain the exclusive property of Canyon Explore. By using the Topo Generator, you do not acquire any ownership rights in the Generated Content.
8.2 Permitted Use
You may use Generated Content solely for the purpose of uploading it to our platform’s database or for personal, non-commercial reference. You may not reproduce, distribute, publicly display, sell, sublicense, or otherwise exploit the Generated Content for commercial purposes or outside the platform without our explicit written consent.
8.3 Reservation of Rights
We expressly reserve all rights, including copyright, trademark, patent, and any other intellectual property or proprietary rights, in the Generated Content. You agree not to contest or infringe these rights in any manner.
8.4 Restrictions
You may not:
- Modify, reverse engineer, decompile, or attempt to extract the source code or underlying data of the Topo Generator.
- Use the Generated Content to create derivative works for commercial purposes.
- Share, distribute, or publish the Generated Content outside the platform without explicit permission.
8.5 Disclaimer of Liability
We do not guarantee the accuracy, completeness, or suitability of the Topo Generator or any Generated Content. The Topo Generator is provided "as is", and we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We shall not be liable for any errors, omissions, or damages arising from the use of the Topo Generator or Generated Content.

9. Indemnification
You agree to indemnify, defend, and hold harmless Canyon Explore, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:- Your use of the Topo Generator or any Generated Content in violation of these Terms of Use;
- Any infringement of third-party intellectual property rights or other rights by content you generate or upload;
- Any breach of these Terms of Use by you.
This obligation survives the termination of your access to or use of the platform.

10. Changes to the Terms
We may update these Terms of Use from time to time. Continued use of the platform after changes constitutes acceptance of the new terms.
